PETALING JAYA: The attorney-general has agreed to classify the case of a security guard, who was attacked while on duty at a condominium swimming pool in Ipoh last December, as murder.

Businessman Ahmad Noor Azhar Muhammad, 33, was charged this morning with murder under Section 302 of the Penal Code.

No plea was taken.

The homestay guest had previously been charged in the magistrates’ court on Jan 6 under Section 335 of the Penal Code with causing grievous hurt. The case was scheduled to be mentioned again today for sentencing.

The prosecution today was conducted by Perak prosecution director Azalina Rasdi before magistrate Noor Azreen Liana Mohd Darus.

Noor Azhar is accused of killing the guard, Thava Sagayam Santhanasamy, 64, between 8am and 9.30am on the 7th floor of Menara Majestic at Jalan CM Yusuff, Ipoh.

The accused was represented by Ariff Azami Hussein, while M Kula Segaran held a watching brief for the victim’s family.

The court set Oct 18 to remention the case. Noor Azhar was not offered bail.

Meanwhile, Perak police chief Mior Faridalathrash Wahid said in a statement that no party should cast negative perceptions on the police over their investigations into the case.

He said inaccurate and misleading statements could prejudice the case.

“We are doing our best to ensure that security and peace are maintained. We want to work with the community in maintaining law and public order,” he said.
