Court rejects govt’s bid to forfeit luxury items seized from Pavilion Residences

KUALA LUMPUR: The High Court has dismissed the government’s bid to forfeit jewellery, luxury watches and handbags seized by police from Pavilion Residences after the 2018 general election.

Justice Muhammad Jamil Hussin said the Attorney-General’s Chambers (AGC) had failed to prove that the valuables were linked to 1MDB funds.

The government wanted to forfeit the items seized from the premises, owned by Obyu Holdings Sdn Bhd. They included 2,435 pieces of jewellery, seven watches and 29 handbags.

Deputy public prosecutor Faten Hadni Khairuddin told the court they will be appealing the decision.

She also requested the court to allow them to retain possession of the items pending the appeal process.

The court rejected Faten’s request to suspend the judgment and for the AGC to retain the items pending appeal.

“There is no need for the court to make a ruling on the third party claimants (Najib Razak and Rosmah Mansor),” he said.

Lawyers Shafee Abdullah and Azamuddin Abd Aziz appeared for Najib and Rosmah, respectively, as the third parties.

Last year, the same court dismissed the government’s application to forfeit more than RM114 million in cash seized by police at Pavilion Residences.
